  • Terms and Conditions

The following conditions govern the course of the Runes of Magic Snowflake Festival Comic Strip Contest (hereafter ‘contest’) as organised by Gameforge 4D GmbH, Albert-Nestler-Strasse 8, 76131 Karlsruhe, Germany (hereafter ‘Gameforge’).

    1. Eligibility, Participants and Participation

    (1) Participation in the contest is free. All users of full age, who comply with the requirements of the Standard Terms and Conditions of Use, and who have a personal, active account (‘account’) for runesofmagic.gameforge.com are eligible to enter. Employees of Gameforge and companies associated with Gameforge, as well as relatives thereof, are allowed to participate but are excluded from receipt of any prizes.

    (2) A ‘participant’ is any person entitled to participate as per (1) who participates as described in (3) between 17th December 2018 and 1st January 2019, 11:59 PM CET (‘participation period’).

    (3) The subject of the contest is the creation and arrangement of four screenshots with comic-style text (e.g. speech bubbles) in English which together form a short story on the subject of the ‘Snowflake Event’ in the world of Runes of Magic (‘creation’). This must be submitted within the participation period in accordance with the following requirements (‘entry’):

    a) The creation must be submitted in .jpg, .tiff, .bmp, .gif or .png format with a maximum file size of 50 MB and must be unencumbered by third-party rights.

    b) The screenshots may be edited for the purposes of altering the file format and size, as well as introducing text or comic effects.

    c) A character belonging to the respective participant’s account must be portrayed on at least one of the screenshots, while the user interface should be hidden, in particular so that no personal data (such as character names or chat messages) are visible.

    d) The entry must be sent to snowflake_comicstrip@runesofmagic.com from the email address associated with the account with the subject line ‘Snowflake Festival Comic Strip’.

e)The email should include the name of the server played on and the name of the character from the participant’s account. It should also state how the participant wishes to be identified as the copyright holder in the presentation of the creation, should they win. If the participant does not provide any indication of preference, they provide their general agreement that the provision of the character name and server being played on is sufficient as copyright identification. Should the participant prefer to eschew any form of copyright identification, they may indicate as such in their entry.

    (4) Each participant is permitted only one entry. Entries submitted outside of the participation period as well as multiple entries, including entries linked to different accounts will not be considered.

    2. Winners and Prizes

    (1) Gameforge will select 3 creations from all valid entries based on their creativity. The ‘winners’ are those participants who made these selected creations.

    (2) Gameforge will announce the winners by 18th January 2019 on the internet sites (including the Runes of Magic Steam page) and social networks maintained by Gameforge (together the ‘Gameforge sites’) using their character names and game servers, providing the form of copyright identification as per 1(3)(e), and inform them of their win via an email sent to the email address used for the entry (‘notification’).

    (3) The winners will receive prizes as part of the contest announcement. Gameforge will ask the winners in the notification to indicate their desired digital prize in reply by 17th February 2019, 11:59 PM at the latest (‘response’). Responses that Gameforge receives late or does not receive at all will lead to loss of entitlement to the respective prize. The prize will be added to the respective winner’s account shortly after receipt of the response.

    (4) Finally, in recognition of the winners’ creative achievements, Gameforge will present the creations on the Gameforge sites, providing the form of copyright identification as per 1(3)(e) (‘presentation’).

    (5) A cash payment and/or payment of the prize in physical goods as well as an exchange and/or transfer of the prizes to third parties are all excluded.

    3. Rights of Use and Indemnity

    (1) For the purpose of participation in the contest, Gameforge grants the participant the free-of-charge, non-exclusive right to use the required elements of the online game Runes of Magic to the necessary extent.

    (2) For the purposes of the presentation, the participant grants Gameforge the free-of-charge, non-exclusive and irrevocable right to use the respective creation without limitation of time and place. This includes the rights of exploitation and reproduction, as well as the right to make the creation publicly available and grant usage rights to third parties, in so far as this is necessary within the context of the presentation.

    (3) By submitting their entry, the participant provides assurance that they produced the creation themselves, guarantees that this does not infringe on the rights of third parties and indemnifies Gameforge against all claims from third parties based on the infringement of third party rights in connection with the creation.

    4. Data Privacy

    (1) Gameforge will collect the personal data provided by the participants (this being the user data for the account, i.e. the associated character name, email address, and the form of copyright identification chosen per 1(3)(e)) in accordance with data protection requirements and process this exclusively for the purposes of running the contest. This includes checking eligibility for participation and adherence to the participation requirements, as well as delivery of the notification and the announcement of the winners on the Gameforge sites using the copyright identification chosen as per 1(3)(e).

    (2) The personal data collected will initially be stored for the duration of the contest and then subsequently deleted. This excludes the copyright identification chosen according to 1(3)(e) publicised on the Gameforge sites as part of the presentation, which is stored permanently for reasons of transparency. To the extent that legal retention requirements stipulate longer-term storage, the affected data will be deleted at the latest following the expiry of such obligations.

    (3) Further information on Gameforge’s handling of personal data can be found in the Privacy Policy (see in particular point 3.9 regarding the holding of contests and the significant legal basis for processing this data, as well as point 6 on the rights of the data subject).

    5. Disclaimer

Gameforge, its bodies, employees, and subcontractors are liable exclusively for wilful intent and gross negligence, regardless of legal basis, and in cases of ordinary negligence, only for the violation of essential contractual obligations and limited to foreseeable damages, as far as not precluded by other compulsory statutory provisions. These limitations do not apply for the loss of life, personal injury or damage to health.

    6. Final Provisions

    (1) The participant agrees to these Terms and Conditions with their entry.

    (2) In addition to these Terms and Conditions, the Standard Terms and Conditions of Use and the game rules also apply (together the ‘rules’).

    (3) Should a participant infringe upon the rules during the implementation and execution of the contest, or such an infringement be proven thereafter, their eligibility may be revoked.

    (4) Gameforge reserves the right to end the contest before the end of the participation period, if for technical or legal reasons its proper execution cannot be guaranteed. In the event that any individual provisions of these Terms and Conditions become ineffective, the remaining provisions shall remain effective and binding. Statutory rules shall take the place of the ineffective provision.
